Protection and Use of Your Data
With this document, we would like to inform you which data about you are collected and stored within the scope of the use of the fanmiles.com fan loyalty platform and for which purpose we use these data. The declaration of consent comprises part 1 of this document. In part 2, we would like to inform you which data protection-relevant tools and social media plug-ins are used for the operation of the platform.
Part 1 – Declaration of Consent under Data Protection Law
Your participation in the fanmiles.com fan loyalty platform (the "platform" or the "fan loyalty platform") is governed by the following agreements under data protection law. Your declaration of consent applies in favour of FanMiles GmbH, Oranienstraße 6, 10997 Berlin, Germany, as the platform operator.
By approving this agreement, you permit FanMiles GmbH (hereinafter referred to as "we" or "provider") to collect, process and use your data as specified below in the agreed way and in the described scope.
1. Data Collected by Us
1.1 Fan Data
Fan data are data about you (name, date of birth, etc.), your marital status (married, children, etc.) and your contact details (mail, e-mail, mobile phone, etc.). These data are collected during the registration and possibly later on through your input. You may also use the platform under an alias, as the input of data that would enable your identification is voluntary. However, please note that if you do not enter all data, we cannot render all services offered. For example, we can only send an award to you if we know your name and address
1.2 Usage Data
When you use the platform, we collect, store and process your following personal data, especially for the purpose of crediting #fanmiles of the platform and for spending #fanmiles on awards. The data comprise a unique participant number assigned to you, the time, location and type of the transaction that leads to the crediting or spending of #fanmiles of the platform, the number of #fanmiles of the platform, the award obtained, procured goods and services and their price, or the competition or raffle in which you participated.
Furthermore, we collect data that indicate on which websites you interact with plug-ins that are offered by us and integrated by the respective website operator on his website. If you are logged in to the fanmiles.com fan loyalty platform at the same time, we can allocate this interaction to your user account and log it. The collected data comprise the location and date of the interaction, the type of interaction and the subject area (e.g. which contents are currently being displayed on the website).
We do not receive any information on goods and services procured by you if your contractual partner is a pharmacy, in the case of financial services or banking transactions or if the data would allow conclusions to be drawn concerning personal data classifiable as special types of personal data in the meaning of Section 3 (9) of the German Federal Data Act (BDSG). Fan data and usage data are hereinafter collectively referred to as "participant data".
2. Who Gets My Participant Data?
Your participant data will only be transmitted to third parties (also for advertising and market research purposes) if you have separately agreed to this or if this is permitted by law (e.g. forwarding of address details to courier companies for the delivery of awards).
3. For What Purposes Are My Participant Data Used?
We use your participant data for purposes including but not limited to the following:
- Information on your current #fanmiles and FAME credit on the platform and their validity/expiry data
- Information on current offers of the platform, sponsors and partners
- Adaptation of the platform and our offers to your presumed interests and needs
- Crediting of #fanmiles and FAME and spending of #fanmiles of the platform
- Use for advertising and market research
3.1 Participation in the Fan Loyalty Platform
We use your participant data for the purpose of enabling you to participate in the fan loyalty platform and, if necessary, for the settlement between us and the partners of the platform. Your participant data are used especially for the management of your mile balance and for the processing of mile and award transactions. Moreover, the participant data are used for the purpose of submitting offers concerning the platform to you. By using your participant data, these offers are to be adapted to your presumed interests and needs.
3.2 Use for Advertising and Market Research
To be able to offer you the benefits of the fan loyalty platform and to further develop these, we need to generate income with the platform. Instead of billing you for a usage fee, we prefer to make use of other income sources. Therefore, we would like to collect, store and use your participant data for advertising and market research. In this way, we will be able to submit offers for products and services to you (e.g. by displaying personalised advertisements or by means of personalised newsletters) which we consider suitable for your needs and interests. This may be done through the website of the platform, by mail and – provided we are entitled to do so by law or with your consent – by e-mail or another form of digital messaging (e.g. SMS). Additionally, we use your participant data to arrange new and improved offers and services of the platform in order to custom-tailor them more effectively to your presumed personal interests and needs. 4. Revocation of This Declaration
You may revoke this declaration at any time with effect for the future. Please send your revocation to FanMiles GmbH, Privacy, Oranienstraße 6, 10997 Berlin, Germany. Please note that the deletion of your personal participant data is only possible along with the deletion of your account. Your revocation will thus also result in the immediate termination of your account.
5. Your Right to Information and Privacy-related Questions
You can always request information as to which data we have stored about you and how we use them. Should any data be incorrect, we will correct them at your request. Part 2 – Information on Privacy-relevant Tools and Social Media Plug-ins
1. Use of Google Analytics
Please note that on this website, Google Analytics is used in such a way that anonymised logging of IP addresses is guaranteed.
